Liew loses court bid for president post

KOTA KINABALU - Datuk VK Liew lost the battle to wrest the Liberal Democratic Party (LDP) President's post through the courts, Tuesday, but says his political career is not yet over.

"It only means that my journey in court has come to an end but does not mean that my political journey has ended. It will continue in various capacities," said Liew, when met outside the Federal Court after the proceedings, Tuesday.

Chief Judge of Malaya Tan Sri Zulkefli Ahmad Makinudin who sat with Justices Tan Sri Suriyadi Halim Omar, Tan Sri Ahmad Haji Maarop, Tan Sri Haji Mohamed Apandi Ali and Datuk Ramly Haji Ali dismissed Liew's application for leave to challenge the RoS endorsement of rival Datuk Teo Chee Kang as party president with costs after considering arguments from all parties.

Liew had applied for leave to appeal against the Court of Appeal decision to dismiss his application for leave for judicial review to revoke the RoS decision on the position of the President of the LDP.

In their unanimous decision, the apex court justices held that the letter dated Jan. 7, 2014 from the RoS was not a decision and hence not amenable to judicial review.

Liew's leave application for judicial review was dismissed by the High Court on Feb 17 this year and the Court of Appeal had on May 23 this year dismissed his appeal against the High Court decision.

Liew had on Jan. 28 this year filed the application naming the RoS, LDP president Datuk Teo Chee Kang and Senator Datuk Chin Su Phin, who is now the deputy president of LDP, as first, second and third respondents, respectively.

The apex court on Tuesday awarded costs of RM5,000 to each of the respondents. Earlier, counsel Roland Cheng who represented Liew together with Dato' Sri Rakhbir Singh raised six questions in the application.

Cheng, among others submitted that the letter dated Jan. 7, 2014 was not an administrative act because it has elements of decision advice and acknowledgement of dispute and must be read together and not in isolation.

He also said that the 'decision' in the Rules of Court 2012 was not same 'decision' in the Societies Act 1966 and so cannot equate the two.

Senior Federal Counsel (SFC) Shamsul Bolhassan, who represented the RoS together with SFC Rahazlan Affandi Abdul Rahim said the letter was nothing more than an opinion or statement or conclusion as a result of the investigation by the RoS.

He also said that the alleged first respondent's decision was made after the Extraordinary General Meeting (EGM) and elections and that it would not have affected the decisions of the political party made at the EGM nor the rights of the applicant.

Instead, it was the decision of EGM and elections which had affected the legal rights of the applicant and not that of the first respondent, submitted Shamsul.

Liew in his application at the High Court sought a declaration that the RoS had acted ultra vires the Societies Act to say that the purported Extraordinary General Meeting held on Oct 19 and 20, 2013 and subsequent party election were legal.

He also sought that the action by the RoS to issue the letter of Jan 7, 2014 to him is unlawful and null and void and also an injunction to stop the second and third respondents from carrying out duty under the name of LDP.

Counsel Datuk Roderick Fernandez appeared for Teo and Chin.

Thanking his counsel for being with him from the beginning from the High Court to Federal Court, Liew said: "The court somehow has recognised them and also Teo (Datuk Teo Chee Kang) as the President of the Liberal Democratic Party (LDP) appointed by RoS." Liew said he respected the decision of the Federal Court.

"The decision of the court today is that the Registrar of Societies (RoS) has the power to decide who should be the president of a political party. I think that is bad for the political development of this country and it is to me a very sad day for political parties.

"As to where my political direction will take me, I will have meetings with all my supporters. we will have our gathering soon and we will determine where we will go because like it or not, we are all voters as well in our respective constituencies and I believe we will play an important role when the time comes," he said.

Liew thanked his supporters who according to him came from different places such as from Sandakan and here and have been very supportive and loyal to him.

Meanwhile, Teo, when contacted, said it is time for LDP to move on as all legal avenues in the party's leadership tussle have been exhausted.

"We have patiently allowed legal proceedings to take their course. Now that all legal avenues have been exhausted the party will move on," said Teo, when asked to comment on the decision by the Federal Court to dismiss with costs Liew's leave application to appeal to the apex court.

However, Teo who is also State Minister of Special Tasks said the whole LDP leadership saga was not about individuals.

"It is not about VK Liew or Teo Chee Kang, it is about the party as an institution," he said.

RM497k Servay Supermarket grab: Trio charged

Hayoup (right), Binjoon (second right) and Jason (third right)

KOTA KINABALU - A Penampang Servay supermarket staff was among three local men charged with robbing it of RM497,348.75 last month.

The employee Carlos Aronson Z Binjoon, 22, a Kadazan, Hayoup Khan Ghulam, 24, and Jason Lionel, 24, a Visaya, were brought before Sessions Court Judge Azreena Aziz to face the charge.

Meanwhile, a tearful Jason told the court that he did not know anything about the case and claimed trial. Azreena fixed March 16-19 next year to hear the case and offered them bail at RM10,000 with RM5,000 deposited in two local sureties each. All were not represented.

They allegedly robbed a worker of the supermarket and made off with the money belonging to the supermarket at 2.30pm on Oct. 27 this year in front of the Evergreen office at the Wong Kwok Commercial Centre, Penampang.

The offence under Section 395 of the Penal Code carries a jail term of up to 20 years and whipping, on conviction.

The facts of the case stated that on Oct. 27 a Servay Supermarket operation executive, One Kok, lodged a report claiming that their workers who brought along RM495,348.75 in the company's van were robbed by two masked men who used a knife and a taser.

Following the report, on Nov 2, Binjoon was arrested at 4.45pm at a store of the supermarket and Hayoup and Jason at different places. Police recovered RM6,800 at Binjoon's rented room, another RM266,795 from Hayoup in Regency Park, Penampang and RM109,650 from Jason. The money was brought back to the Penampang police station.

Investigations revealed that Hayoup was the mastermind and had discussed with Binjoon and Jason about robbing the supermarket.

Red alert in Sabah over Abu Sayyaf's declaration of support for Isis

KUALA LUMPUR - A red alert has been raised in Sabah following an open declaration of support for the Islamic State (IS) movement by Isnilon Hapilon - one of the most wanted terrorists with up to RM16mil (S$6.3 million) bounty on his head.

The 48-year-old Abu Sayyaf leader, along with masked men, posted a video of themselves on YouTube in July but intelligence sources said it gained momentum on social media last month.

Sources said pro-IS and jihadist websites in Bahasa Malaysia were being watched following this new development.

In the video, which appeared to be shot in the jungles of southern Philippines, the IS movement's symbolic black flag is depicted in the opening scene.

In the six-minute clip, Hapilon is seen wearing a black gown, linking his arms with his men, some of whom wore masks.

Speaking mostly in Arabic and in his native dialect of Yakan, they swore allegiance to IS and its head Abu Bakr al-Baghdadi in the form of baiah or oath of loyalty.

The video clip provided security agencies with the most updated photograph of Isnilon, who appears to have gained weight after previous photographs showed him to be a much thinner person with reports that he had suffered a stroke at one point.

It is believed that the video was meant to inspire support for the IS movement, especially in South-East Asia.

The video was soon followed by Jemaah Islamiah (JI) spritual leader and founder of its reincarnation, Jemaah Ansharut Tauhid (JAT), Abu Bakar Baasyir calling on his followers to join IS.

It is learnt that Abu Bakar had gathered high-ranking JAT leaders and family members at the Pasir Putih prison in Indonesia before ordering them to support the IS.

Wanted by the United States Federal Bureau of Investigation as well as security agencies in Malaysia, Isnilon is said to be responsible for a raid on Pom Pom island in Semporna on Nov 15, 2013.

"He and his men are dangerous and their main business is kidnapping, which is carried out to finance their terror activities.

"He and his men have beheaded an American kidnap victim," said a regional intelligence analyst.

Polis Kenal Pasti Individu Keluar Kenyataan Bawa Sabah Keluar Dari Malaysia?

Sabah, Sarawak petition for self-determination

NGOs aim 300,000 signatures for submission to UN

KOTA KINABALU - Two NGOs, Sarawak Association for Peoples Aspirations (Sapa) and United Borneo Front(UBF) in Sabah - are collaborating to collect 300,000 signatures for the Sabah, Sarawak petition. for self-determination for submission to the United Nations (UN).

The campaign which kicked off on Aug 9 is said to have received over-whelming support from the people but still lacks support from elected representative in both states.

"So far, only three leaders have signed the petition. One elected representative is worth more because he or she represents his or her constituency. It could mean their signatures are worth 100,000 signatures!

"Therefore,it is imperative that our politicians from both sides of the divide unite in support of the cause as their signature would carry more weight," said Sapa President Lina Soo after delivering her presentation at the Malaysia at Crossroad forum here, Thursday.

The forum which entered its second day was grganised by Sabah Progressive Party (SAPP) think tank the Progressive Institute of Public Policy Analysis(PIPPA)

and attended by more than 200 people.

Soo said the association had been travelling all over Sarawak to collect signatures

in order for the petition to be submitted to the UN in New York in six months time.

The campaign in Sabah will be spearheaded by UBF which reported that the campaign is doing well in Sabah. "Other than going to the districts, we have even put a counter for the petition every weekend in Gaya Street for people to sign. People are signing it," said UBF Chairman Datuk Dr Jeffrey Kitingan who is also Bingkor Assemblyman.

The petition is an effort to revisit the original petition for self-determination submitted 52 years ago by Brunei, Sarawak and North Borneo political parties to the UN and was then accepted for hearing in mid-December 1962.

The delegation, however, was forced to abandon their journey to.the UN due to the outbreak of the Brunei Uprising on Dec.8,1962.

Meanwhile, during her presentation, Soo repudiated claims that Sarawakians at the time consented to the Malaysia project. "At the time, there were strong objections to the idea even at the grassroots level.

More than 5,000 people gathered and lined up the road in Miri to show their opposition to the Malaysia idea.

"Along the Rajang river, flags and banners, expressing the people's dismay about Malaysia, were raised with the hope that the UN Commission charged to gather opinion of the people, would see them," she said.

Unfortunately, the movement, which was backed by the Sarawak United People's Party (SUPP), was accused of being communist-motivated and crushed by the British.

During that time, she said, the people wanted the Brooke family to come back and govern Sarawak and eventually grant them independence.

"Declassified documents in London revealed that the heir to the dynasty, at that time, was blocked from leaving London and returning to Sarawak This as how the British played us.

"And this is why we are planning to sue the British Government because of breach of trusteeship They colonised us and left us just like that. It was irresponsible and they must be held liable for violating our rights.

"Because of their irresponsibility and their collusion with Malaya, we have become the victims of Malaya's greed," she said.

Ebola screening teams at KK, Tawau

KOTA KINABALU - The idea of the Ebola virus disease (EVD) spreading to Sabah might be far-fetched but the Ministry of Health (MoH) is not taking any chances.

It has already deployed screening teams at all the State's major points of entry.

Screening teams have been deployed at Terminal One and Terminal Two of the Kota Kinabalu International Airport (KKIA) and also at Tawau Airport.

Screening for the EVD is carried out on the nationals or passengers who have visited three West African nations, namely Guinea, Liberia and Sierra Leone.

To achieve this, the Health Department is working very closely with the Immigration Department to identify travellers who have visited the three countries concerned as well as nationals from there.

International passengers who made transits in Hong Kong are also subjected to the screening exercise.

Dr Timothy Williams, Consultant for Infectious Diseases at the Queen Elizabeth Hospital (QEH), said there are five different strains of the Ebola virus, four of which could cause severe disease in humans and animals. Using statistics from the World Health Organisation (WHO) dated July 27 this year, he said there have been about 30 Ebola outbreaks since 1976.

This year alone, there were more than 600 cases of deaths caused by Ebola.

Ebola virus, he said, is very infectious where very small amounts of the virus could cause an infection.

"It is moderately contagious and can be spread from an infected human to another.

"It spreads through contact of body fluids from an infected person or objects that are contaminated by an infected person," he said.

Nevertheless, he assured that the virus is not airborne or spread by air.

But the virus is so infectious that even mourners in burial ceremonies that have direct contact with the body of the deceased can be infected.

"In fact, this is one of the main ways the disease is spread," he said.

Even health-care workers, despite the stringent measures they take in protecting themselves, have frequently been infected while treating patients with suspected or confirmed EVD.

Dr William said as of Aug 1 this year, 60 healthcare workers have died of EVD. He said the current outbreak is the only one to have occurred in urban areas and to cross national borders.

"So far, we have no cases of Ebola in Malaysia (but it is possible for someone in our country to get this infection) if the person is infected when visiting an affected country or if someone gets infected from an affected country and comes to Malaysia. In today's world that is interconnected, a disease is just a plane ride away," he said.

Dr Sen Nathan, Deputy Director of Sabah Wildlife Department, said the reservoirs of Ebola infection in West Africa are fruit bats.

While the species differ from the fruit bats found in Asia or Sabah in particular, they are mostly common bats.

In West Africa, he said, the EVD spread quite rapidly due to its thriving bush meat trade.

The virus, he said, has been cohabitating in the bats for decades but a surge in the human chain of activities have caused the virus to be spread among the human population.

This happens when the human population edges closer to the wildlife habitation that was previously not disturbed.

Ebola virus-carrying bats, he said, defecated and urinated on pigsties and caused the virus to be spread to them.

Subsequently, human consumes the animals and thus gets infected with the virus.

He believed that similarly the Nipah virus and Avian flu were also spread by animals.

Meanwhile, Dr William said the EVD is severe and can occur suddenly.

"They will be weak, develop fever, diarrhea, vomiting and stomach pain.

Other symptoms include severe aches, rash, red eyes, chest pains, sore throat, difficulty in breathing, difficulty swallowing and finally external and internal bleeding," he said.

Laboratory findings, he said, include low while blood cells and platelet counts and elevated liver enzymes.

The disease, he said, is very serious where 90 per cent of the people infected can die.

"The WHO said there have been more than 1,600 cases of Ebola since the disease emerged in West Africa this year.

"Last Monday, it said the death toll had reached 887 in Guinea, Sierra Leone and Liberia, as well as Nigeria," he said.

Currently, Dr William said there is no known vaccine or medicine for the disease.

"Patients are given supportive care with the hope that their own immune system and body will overcome the infection," he said. But there is some hope with the introduction of an experimental drug known as Zmapp.

It was developed by the San Diego-based biotech firm Mapp Biopharmaceutical Inc.

It was previously not tried on human beings but had shown promises in small experiments with monkeys.

The conditions of two healthcare workers from the US who were infected, Dr Ken Brantly and Nancy Writebol, have significantly improved after receiving this medication.

Although it is still too early to confirm the ZMapp as a definitive treatment, the improvement on Brantly and Writebol gives some hope that it might one day be available in the near future.

Dr Brantly, has since returned to the US but is still being restricted to confinement.

The disease can be prevented from spreading through strict and effective infection control in the hospitals and health care settings when taking care of these patients, said Dr William.

Cop abductor Abu Sayyaf leader Alhabsi beheading hostages in gruesome video

PETALING JAYA - More details are beginning to emerge of Alhabsi Misaya, the notorious Abu Sayyaf leader, who is said to be holding marine policeman Kons Zakiah Aleip hostage in southern Philippines.

He is one of the gunmen responsible for the beheading of seven factory workers in Jolo, Southern Philippines in 2007, as discovered in an online video.

The 14-minute video clip, recorded by Alhabsi himself, sees a group of gunmen leading the hostages to different spots in the jungle where the brutal act is carried out

Alhabsi can be heard reciting Quranic verses as the first hostage is made to lie face down before his head is pulled back by one of the gunmen and severed with what appears to be an army knife.

The next hostage is then led a few hundred metres away and meets a similar fate, much to the enjoyment of Alhabsi, who is heard giggling and chanting ‘Allahuakbar’ (God is great).

The recording depicts the killing of each worker in gory detail, and at one point, Alhabsi even zooms in on a severed head while making a celebratory comment.

Later, he very briefly turns the camera to himself, and the face is clearly visible to be that of the man identified by Philippines and Malaysian intelligence forces as the rising leader in the Abu Sayyaf terror group.

Towards the end of the video, the gunmen approach the remaining hostage and are seen tying his hands behind his back while asking him several questions.

They then lead him into the jungle, but his fate is unknown, as the recording ends abruptly.

The video clip, titled Seven innocent people in Jolo, Sulu beheaded by Abu Sayyaf group was uploaded on YouTube by a Raymond Penny in July last year, and has garnered more than 5,000 views to date.

The workers, who were employed at a nearby plywood factory, were apparently abducted and beheaded after the company refused to pay extortion money to Abu Sayyaf for carrying out logging in the area.

Alhabsi, then only a junior member of the terror group, has since risen in the ranks after making millions of pesos in ransom money from the spate of kidnappings in the east coast of Sabah.

Zakiah, 26, was snatched from a resort in Sabah’s east coast when eight masked gunmen in military fatigues attacked Mabul Island last Saturday. The gunmen also killed another policeman, Abdul Rajah Jamuan, 32.
